Draft, to be reviewed by a lawyer. These terms are not yet in force.
Terms of use
These terms are an agreement between you and aeirme (ABN 50 360 498 179), a Sydney, NSW business ("aeir", "we", "us") about using aeirbase. By signing in you agree to them. Our privacy policy explains how we handle personal information.
1. Your account
- aeirbase is invite only. Each account is for one person; don't share it.
- You sign in with a link or a 6-digit code sent to your email. Keep your email account secure, and don't forward sign-in emails: anyone with the link or code can sign in as you.
- Tell us straight away at hello@aeir.me if you think someone else has used your account.
2. Your data
What you put into aeirbase is yours. We host it so the service works, and we don't use it for anything else. Other operators can't see your listings, pipeline, agents, contacts, messages, recordings, keys or settings.
Public listing information (what a listing page shows) is pooled into one shared list for all accounts, so everyone sees new listings sooner. Pages your add-on views are added to that shared list. Nothing private from your account is added to it.
3. You decide what is sent
aeirbase never sends an email or text, makes a call, records a call or moves a lead without you choosing to. You are responsible for what you send and say, and for following the law, including:
- the Privacy Act 1988 for the personal information you collect about agents, landlords and others;
- the Spam Act 2003 for emails and texts (consent, saying who you are, and a way to opt out);
- telemarketing rules and the Do Not Call Register for calls;
- surveillance and listening device laws for recording calls: ask the other person first.
4. The browser add-on and other sites
- The add-on reads listing pages on realestate.com.au and Domain that you view. Follow those sites' own terms when you use them.
- "Share the crawl" is off unless you switch it on. When it's on, your add-on reads a small share of the shared queue at its own slow pace. If a site shows your browser a check, your add-on stops; aeirbase never tries to get around a site's checks or limits.
- You can switch the add-on or crawl sharing off at any time.
5. Your own keys and connected services
If you add your own keys for AI or voice services, or connect Gmail, you pay those providers directly and their terms apply to you. Remove a key or disconnect a service at any time in Settings.
6. What you must not do
- Use aeirbase for anything unlawful, misleading or harassing, or to send spam.
- Try to reach another account's data, test or get around aeirbase's security, or overload the service.
- Copy, resell or rent out aeirbase or the shared listing list.
7. Fees
aeirbase is free while it is invite only. We'll give you at least 30 days' notice before any charge, and you can leave before it starts.
8. The service
We work to keep aeirbase running and backed up, but we can't promise it will always be available or free of errors, or that listing information is complete or correct. Check important details (such as rent and availability) with the agent. Keep your own copy of anything you can't afford to lose. We may change or improve features over time.
9. Liability
Nothing in these terms limits your rights under the Australian Consumer Law. To the extent the law allows, we aren't liable for indirect loss or lost profits, and our total liability to you is limited to resupplying the service. [Reviewer: confirm this clause.]
10. Ending your account
- You can ask us to close your account at any time. We'll delete your data as the privacy policy describes.
- We may pause or remove an account that breaks these terms. Except for serious breaches, we'll tell you first and give you a chance to fix it or take a copy of your data.
11. Changes to these terms
We'll tell you by email at least 14 days before a change that matters. If you keep using aeirbase after that, the new terms apply.
12. Law
These terms are governed by the law of New South Wales, Australia.
